These Mobile Terms of Service (“Mobile Terms”) govern your participation in the Holiday Designs™
text messaging program (the “Program”) operated by HDMS LLC dba Holiday Designs™ (“we,” “us,” or “our”).
By opting in to receive SMS messages from us, you agree to these Mobile Terms.

1. Program Description

By providing your mobile number and expressly opting in, you agree to receive text messages from Holiday Designs™ regarding:

  • Order confirmations and updates
  • Shipping and delivery notifications
  • Project coordination communications
  • Appointment reminders
  • Promotional offers and seasonal announcements (if separately consented)

Message frequency may vary depending on your interaction with us.
Message and data rates may apply.

2. Consent to Receive Messages

By opting in, you confirm that:

  • You are the authorized user of the mobile number provided.
  • You are at least 18 years old.
  • You provide express consent to receive text messages from Holiday Designs™.
  • Consent is not a condition of purchase.

We do not send messages without documented opt-in consent and do not use purchased or rented phone lists.

3. Opt-Out Instructions

After you send “STOP,” you will receive a confirmation message, and no further messages will be sent unless you re-subscribe.

Carriers are not liable for delayed or undelivered messages.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties.

7. Program Modifications or Termination

We reserve the right to modify or terminate the Program or these Mobile Terms at any time.
Any changes will be effective upon posting an updated version on our website.

8. Limitation of Liability

To the fullest extent permitted by law, HDMS LLC and Holiday Designs™ shall not be liable for any indirect,
incidental, special, consequential, or punitive damages arising out of or relating to participation in the Program,
including delayed or undelivered messages.

9. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Mobile Terms or the SMS Program shall be resolved through
binding arbitration conducted in the State of Georgia under the rules of the American Arbitration Association.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
All claims must be brought individually.

This agreement is governed by the laws of the State of Georgia, without regard to conflict of law principles.
